How do you start a class action lawsuit?!


Question: How do you start a class action lawsuit.?
Or should I do something else.? Just file a complaint.?
I went to a low-budget dental chain in my area. They put out coupons that compete with a dentist that serves low income people. They sell cheesy insurance to lower their prices to about the same price. The low income dentist is very good, but difficult for me to get to. So, I have a broke tooth, and I went for an appointment. I had them do a full exam, because I had not been to a dentist for a while. They said I had 6 cavities in various teeth. She did a very weird exam, visual, did not check each tooth. I was uncomfortable so I called the low income dentist. They said they fix alot of the budget dentists work. Everyone I have spoken to says bad things about them. I had forgotten I took my daughter there once, a long time ago. They said she needed braces. She has one little, slightly crooked tooth, like mine, no problem. She also had Medicaid. She begged to go back to her old dentist. I also found out a friend had a problem, the same Dr. drilled in her wrong tooth. So, I went to the good dentist. They said I DO NOT have those 6 cavities. I have one so little I can leave it alone in a totally different tooth. (I will treat it though) Should I keep trying to find a lawyer to look at them.? Did this dentist actually do any work on your teeth.? Cause if he didn't, then I'm not sure you have any grounds for a lawsuit.?....

But your friend on the other hand may have a case. But bear in mind that dental cases usually have a low damage rate, unless there is some sort of permanent damage.

The action in question must have been professionally unreasonable at the time it was done. Dentistry is more an art than a science and perfection is not required. Failure to diagnose may or may not be negligent... But it is expensive to find out.

Most lawyers will not take on these sort of cases, but if you do go ahead, make sure you find one who specialises in these type of cases.

I appreciate what you are trying to say hon... And personally, I wasn't trying to accuse you of such... But it still boils down to the fact that unless you can prove beyond reasonable doubt that this dentist deliberately tried to harm you (or anyone else) then there are no grounds for a lawsuit... (Cash settlement or otherwise).

Do a little research... Speak to other surgeries in the area and see if they have had to correct work from this place. Get letters, ask them to pass on your details to the patients in question so you can speak to them. Gather a case file and go to a lawyer who can offer you a free consultation. At least then you'll have more evidence and a more professional opinion!

You did not get the cavities filled, so I don't see why you would want to sue. You have not been harmed by this dentist. Health Question & Answer

They haven't actually done any "work" on you per say and haven't really caused you anything more than the stress of saying something wasn't right when all was fine --- Honestly, I would count my blessings and find another dentist!

If you want to file suit, I would start out by reporting them to the medical review board or something. If you know they are making mistakes, you can at least see if someone can look into their cases... and use your case as an example (greatfully nothing was really done to you before you found out).
